This warranty is subject to the following conditions and is exclusive and in lieu of all other warranties whether written, oral, or implied, and is in effect for a period of 12 months from date of shipment.
In cases where the equipment requires field initiation and/or Buyer’s acceptance of performance testing at Buyer’s facility, initiation and/or performance testing must be conducted by an L.A.B. Service Technician or a certified L.A.B. Third Party Representative, and equipment shall be warranted for a period of 12 months from the date of initiation or buyer’s acceptance of performance testing, but in no case shall the 12-month warranty period begin more than 90 days after shipment of equipment from L.A.B.’s facility.
We warranty the products of our manufacture to be free from defects in material and workmanship and capable of functioning to its specification, and shall at our option agree to repair or replace such components found to be defective in ordinary usage. We warranty components purchased from outside vendors, and incorporate in our products, to the extent of the manufacturer’s warranty. Abuse of components will void the warranty. The original manufacturers’ warranty shall be considered void if the equipment is modified, altered, transferred, or in any way subjected to changes from the original construction.
Consumable items such as oil filters, seals, batteries, and other items subject to normal wear and/or replacement are not subject to warranty if their failure is due to normal wear.
Removal of any protective guards or personal safety devices shall cause this warranty to be null and void. L.A.B. reserves the right to reject those claims for warranty where it is determined that failure is caused by damage in shipping, improper maintenance, improper installation, repair or modifications, in which case the customer will be responsible for all costs incurred for parts, labor, travel, and shipping costs.
Claims for all defective components shall be honored upon evidence that the use has followed all recommended operation and maintenance procedures.
L.A.B. reserves the right to request the prepaid return to its plant of such components, and reserves the right to determine whether the components or assemblies shall be repaired or replaced. In no event shall L.A.B. be liable for special or consequential damages under any circumstances.
